Sanral clarifies test case progress

Sanral today clarified that no test case or indemnity from prosecution has been agreed with Outa.

Sanral's legal representatives, Werksmans, have confirmed that no such agreement has been concluded, although the parties are in discussion about agreeing a possible test case.

This follows Outa's challenge that Sanral consults its lawyers - after it had denied claims by Outa that an agreement had been reached that Outa members now have immunity from legal action. Sanral's attorneys have also clarified the matter with Outa's attorneys.

Sanral spokesperson Vusi Mona said: "It is important for road users to be fully informed and not to be misled by incorrect statements made by Outa. There is no blanket immunity for anyone who is an Outa member or who joins Outa.

"There has not and will not be any such indemnification by Sanral of Outa members. If Outa insist that such an agreement was reached, they are welcome to produce the copy of such a signed agreement or approach the court to clarify the matter."
